“春弦拾音”提琴专场拍卖会公告
受相关方委托，依据《中华人民共和国拍卖法》及相关法律法规，值此上海之春国际提琴文化周举办之际，上海宝江拍卖有限公司倾力打造“春弦拾音”提琴专场网络在线拍卖会。本次专场聚焦国际制琴赛事获奖佳作与中外名家大师匠心作品，提琴拍品2000元起拍，诚邀广大乐器鉴赏家、资深藏家及音乐爱好者踊跃参与，共赏东方弦韵与西方制琴技艺交融的艺术盛宴。现将本次拍卖会有关事项公告如下：
一、拍卖标的
本次拍卖标的甄选精良，汇聚海内外顶尖提琴艺术珍品，核心涵盖三大类，重点突出获奖精品与名家力作：
1、国际制琴比赛获奖原琴：集结多位中国顶级制琴师在全球顶级赛事的获奖原作，包括美国VSA国际提琴制作比赛音色大奖、意大利斯特拉迪瓦里国际制琴三年赛银奖、波兰维尼亚夫斯基国际比赛音质最高奖、首届中国国际提琴制作比赛最佳风格奖等赛事获奖原琴，每一把均经国际权威赛事认证，代表当代中国制琴顶尖水准。

1、凡具备完全民事行为能力的自然人、法人、非法人组织均可参加竞买。法律、法规和司法解释等对买受人资格或者条件有特殊规定的，竞买人应当具备规定的资格或者条件。

网络拍卖须知
为规范拍卖行为,维护当事人合法权益,根据《中华人民共和国拍卖法》及相关法律、法规、规章,特制定本须知。
一、拍卖活动应遵循公开、公平、公正、诚实信用的原则，依法实施的拍卖行为具有法律效力。拍卖当事人应遵守本须知并受此制约。
二、竞买人是指参加竞购拍卖标的的公民、法人或者其他组织。法律、行政法规和拍卖公告等对拍卖标的的买卖条件有规定的，竞买人应当具备规定的条件。
三、竞买人于规定时间内按要求办理登记手续，参加竞买。竞买人应使用本人名下的卡帐支付，如竞买人使用他人名下的卡账支付的，由此产生的法律后果由竞买人承担。拍卖保证金、成交价款和佣金由他人代为支付的，必须签署《代付款承诺书》。
四、竞买人委托代理人竞买，代理人须提交有效的委托文件及本人身份证明。否则将视为代理人以自己的名义竞买。
五、委托人不得参与或委托他人代为竞买自己委托的拍卖标的。
六、委托人在拍卖开始前要求拍卖人撤拍的，拍卖人可以撤回拍卖标的。
七、拍卖人应当按规定在拍卖前展示拍卖标的,并提供查看拍卖标的的条件及有关资料。竞买人可以在公告规定的咨询展示期内,实地勘察拍卖标的物,充分了解拍卖标的情况,必要时应聘请专家帮助,避免盲目竞买。
八、拍卖人应当向竞买人说明已经知道或者应当知道的标的瑕疵。拍卖人将标的情况予以明示的,对明示文件界定内容的真实性承担责任。
拍卖人在拍卖前声明不能保证拍卖标的的真伪或者品质的,不承担瑕疵担保责任。为此所作的文字说明、图片目录和估价等仅供竞买人参考。
九、本次拍卖活动计价货币为人民币，拍卖时的起拍价、成交价均不含税费和买受人在拍卖标的物交割、过户时所发生的全部费用。
十、网络竞买人在参加竞买之前应当了解网上竞买流程，竞买人应对其账号和密码的安全负责，通过竞买账号所做出的任何操作行为，视为竞买人本人的行为，由此产生的后果，由竞买人自行承担。
十一、拍品竞拍倒计时少于5分钟时有人出价，则倒计时时间延长至5分钟，直到无人出价倒计时归零，竞价结束。
十二、本次拍卖采用增价拍卖形式，由竞买人按网页内的加价幅度加价竞买，不符合加价幅度的竞价无效，至拍卖倒计时结束，最高出价者竞得拍品。竞买人在竞买时应理性竞价，避免因冲动或义气用事给自己带来不必要的损失。所有出价一旦生效，不得撤回。竞买人在竞买过程中一定要认真严肃地进行竞价，一经竞价，不得反悔，否则拍卖保证金不予返还，并承担其他经济责任。
十三、网络拍卖存在多种不确定因素或风险，如遇网络迟滞或断网等不可预知因素，导致网络竞买人无法出价，相关技术部门应尽快排除故障恢复运行，但委托人、拍卖人不承担由此给竞买人造成的直接或间接的损失。
十四、标的拍卖成交，最高应价的竞买人随即成为该标的买受人。买受人应当在规定的时间内与拍卖人签署《拍卖成交确认书》和其他需要签署的文件，并在约定期限内付清成交价款和佣金。
竞买人未竞得拍卖标的的，拍卖人应当退还其交付的保证金。未竞得拍卖标的的竞买保证金，于拍卖日后的3个工作日内向原付款账户办理退款手续。
十五、拍卖成交后，拍卖人须按照约定向买受人交付标的物。
买受人未能按约定受领拍卖标的的，自约定交付之时起即对标的承担风险责任，并承担由此产生的费用。
买受人未按约定履行义务的,应依法承担违约责任，保证金不予返还。拍卖人有权保留追溯的权利。
十六、拍卖标的须依法办理证照变更、权属转受让登记的,买受人应持拍卖人出具的成交证明和有关资料，会同委托人向有关管理机关办理相关手续，拍卖人予以协助服务。
买受人应当按照法律、法规的规定处置其购得的拍卖标的,依法履行相关义务。
十七、参加拍卖的竞买人应当遵守竞买须知的规定，不得阻挠其他竞买人竞拍，不得操纵、垄断竞拍价格，严禁竞买人恶意串标，上述行为一经发现，将取消其拍卖资格，并追究相关的法律责任。
十八、买受人未按照约定付款的，应当承担违约责任,或者由拍卖人征得委托人的同意，将拍卖标的再行拍卖。拍卖标的再行拍卖的，原买受人应当支付第一次拍卖中本人及委托人应当支付的佣金。再行拍卖的价款低于原拍卖价款的，原买受人应当补足差额。
十九、竞买人、买受人须遵守本须知；拍卖人在每次拍卖时对不同标的制定专项规则或约定的，则从专项规则或约定。
委托人、竞买人:如果您认为拍卖人主持的本次拍卖会有违反《拍卖法》的情况,致使您权益遭受侵害的,您可以向上海市工商行政管理机关投诉、举报。举报电话 :54236252。
拍卖须知
1. 本拍卖规则依照《中华人民共和国拍卖法》及其他相关法律、条例，参照国际通行拍卖惯例及境内实际情况，结合本公司章程制定。
2. 本公司将在中华人民共和国法律、法规、条例、公司章程及本规则界定的范围内组织和开展各项拍卖活动。本公司将严格遵守公开、公平、公正和诚实信用的原则，维护国家和当事人的合法权益不受侵害。
3. 本规则未作规定的疑问或特殊事项，由本公司拥有解释权。在执行本规则过程中，相关各方如发生争议，应向中国法院提起诉讼。
4. 参加网络拍卖会的竞买人须仔细阅读本《拍卖规则》，并依此对自身在拍卖活动中的行为承担相应责任。
5. 竞买人应为与竞买标的相适应资质的法人或个人，且应按本场拍卖公告规定的时间办理竞买登记手续。竞买人参与拍卖须凭有效个人身份证、护照，或有效企业法人营业执照原件及复印件、法人代表资格证明、法定代表人身份证（复印件）、法人授权委托书以及经办人身份证等材料（所有复印文件均需加盖公章），完成网络账号注册。经审核通过后，方可缴纳拍卖保证金参与网络拍卖。
6. 参与网络拍卖会的竞买人仅可对应一个账号（用户名），该账号仅供竞买人本人使用。凡使用竞买人的账号和密码登录后进行的操作，均视为该竞买人的行为，竞买人应当对以其账号进行的所有行为承担法律责任。
7. 竞买人不得将其账号、密码转让或出借予他人使用。如竞买人发现其账号遭他人非法使用，应立即通知本公司。因黑客行为或用户自身过失导致账号、密码遭他人非法使用的，本公司不承担任何责任。
8. 本场拍卖会以网络拍卖方式进行竞买，拍卖网址：www.a1234567.cn、www.gpai.net/bj。
9. 本次拍卖的拍品采用增价拍卖形式。拍卖会开始后，竞买人可在拍品详细页面按固定竞价阶梯出价，也可直接报价。拍卖会结束后，当前报价最高的竞买人即为买受人，该标的的竞价程序终止。拍品未达底价的，不予成交。
10. 鉴于互联网的特殊性，网络竞拍仍存在多种风险，该等风险包括但不限于：系统故障、设备故障、通讯故障、停电、网络故障、计算机病毒、数据中断延时、数据错误、黑客攻击、自然灾害等不可抗力因素，拍卖人对前述风险造成的损失不承担赔偿责任。
11. 拍卖成交后，本公司出具拍卖成交确认书，由买受人签字确认。买受人另须按拍卖成交金额的15%支付拍卖佣金。买受人对其所购标的，须按照法律法规及规章的有关规定处置。
12. 拍卖成交后，除非另有约定，买受人须在7日内付清全部成交价款及拍卖佣金。如买受人逾期支付，即视为违约，已付款项不予退还，且本公司将依据相关法律法规追究买受人的其他法律责任。
13. 买受人在付清全部款项后，即取得该拍卖标的的所有权，并可办理标的领取手续；买受人应于付清全部款项后的7日内办理拍卖标的领取手续。若买受人超过领取期限仍未领取，除买受人与本公司另有协议外，自拍卖成交日后第八天起，本公司将对买受人未支付款项部分按日息千分之一计收保管费。前述期限届满后，拍卖标的发生任何意外事故造成的损失，均由买受人承担。同时，因买受人逾期领取产生的拍卖标的在本公司存放期间的相关费用（包括搬运、储存、保险及其他一切费用），均由买受人承担；买受人还应赔偿因此给本公司造成的一切经济损失。
14. 本场拍卖会的所有拍品均来自社会委托，所有拍品虽经本公司聘请专家认真鉴赏，但鉴于拍品的特殊性和复杂性，本公司郑重声明：对拍卖标的的介绍和描述不作任何保证和担保。竞买人应在拍卖前自行审鉴所有拍品（可自行聘请专家协助鉴定和鉴别），并对其竞买行为承担法律责任。竞买人一经应价，即表明其接受该拍卖标的的一切现状（包括瑕疵）。
15. 竞买未成交的竞买人，可在拍卖会结束后3-5个工作日内，凭相关凭证领取全额拍卖保证金（保证金不计付利息）。
16. 买受人成功竞得拍卖标的后，对该拍卖标的的处置必须遵守国家相关法律、法规和规定。因买受人处置标的不当引发的任何纠纷，本公司不承担任何责任。
17. 本场拍卖会的相关影音及图录资料，其著作权归上海宝江拍卖有限公司所有。未经本公司书面许可，任何单位或个人不得以任何形式复制、传播前述资料。
Auction Rules
1. These Auction Rules are formulated in accordance with the Auction Law of the People's Republic of China and other relevant laws and regulations, with reference to internationally accepted auction practices and the actual circumstances in China, and in conjunction with the Articles of Association of our company.
2. Our company shall organize and conduct all auction activities within the scope defined by the laws, regulations and articles of association of the People's Republic of China and these Rules. We shall strictly abide by the principles of openness, fairness, impartiality and good faith, and safeguard the legitimate rights and interests of the state and the parties concerned against infringement.
3. For any questions or special matters not stipulated in these Rules, our company shall have the right of interpretation. In the event of any dispute among the relevant parties in the course of implementing these Rules, the dispute shall be submitted to the people's courts of China for litigation.
4. Bidders participating in the online auction shall carefully read these Auction Rules and be liable for their own acts in the auction activities in accordance herewith.
5. A bidder shall be a legal person or a natural person with the qualifications matching the subject matter of the auction, and shall complete the bid registration formalities within the time specified in the auction announcement for this event. To participate in the auction, a bidder shall register an online account by presenting a valid personal ID card, passport, or the original and photocopies of a valid business license of enterprise legal person, certificate of legal representative qualification, photocopy of the legal representative's ID card, power of attorney for legal person and the handler's ID card, etc. (all photocopied documents shall be affixed with the official seal). Only after passing the review may the bidder pay the auction deposit to participate in the online auction.
6. A bidder participating in the online auction may only correspond to one account (user name), which is for the bidder's own use only. Any operation conducted after logging in with the bidder's account and password shall be deemed as the act of the bidder, who shall bear legal liability for all acts conducted through the account.
7. A bidder shall not transfer or lend his/her account and password to others for use. If a bidder finds that his/her account is used illegally by others, he/she shall immediately notify our company. Our company shall not assume any liability for the illegal use of an account and password caused by hacking or the bidder's own negligence.
8. The auction for this event shall be conducted online, with the auction websites as follows: www.a1234567.cn, www.gpai.net/bj.
9. The lots of this auction shall be sold by way of ascending bid. After the start of the auction, bidders may place bids in accordance with the fixed bidding increments on the detailed page of the lot, or make direct quotations. Upon the conclusion of the auction, the bidder with the highest current quotation shall be the buyer, and the bidding process for the subject matter shall be terminated. No transaction shall be concluded if the bidding price of a lot fails to reach the reserve price.
10. Due to the particularity of the Internet, online bidding is still subject to various risks, including but not limited to: system malfunctions, equipment failures, communication breakdowns, power outages, network faults, computer viruses, data interruption or delay, data errors, hacking attacks, natural disasters and other force majeure events. The auctioneer shall not be liable for any losses caused by the aforesaid risks.
11. Upon the conclusion of a successful auction, our company shall issue an Auction Confirmation Letter, which shall be signed and confirmed by the buyer. The buyer shall additionally pay an auction commission equivalent to 15% of the transaction price. The buyer shall dispose of the purchased subject matter in accordance with the relevant provisions of laws, regulations and rules.
12. Unless otherwise agreed, the buyer shall pay the full transaction price and auction commission within 7 days upon the conclusion of a successful auction. If the buyer delays the payment, it shall be deemed a breach of contract, the paid funds shall not be refunded, and our company shall hold the buyer liable for other legal responsibilities in accordance with relevant laws and regulations.
13. The buyer shall acquire the ownership of the auction subject matter upon full payment of all funds, and may complete the formalities for collecting the subject matter; the buyer shall complete the formalities for collecting the auction subject matter within 7 days after full payment of all funds. If the buyer fails to collect the subject matter beyond the collection period, unless otherwise agreed between the buyer and our company, our company shall charge a custody fee at the rate of 1‰ daily interest on the unpaid amount of the buyer starting from the 8th day after the auction transaction date. Any losses caused by accidental incidents to the auction subject matter after the expiration of the aforesaid period shall be borne by the buyer. Meanwhile, all relevant expenses incurred during the storage of the auction subject matter at our company due to the buyer's delayed collection (including handling, storage, insurance and all other expenses) shall be borne by the buyer; the buyer shall also compensate our company for all economic losses caused thereby.
14. All lots of this auction are consigned by social parties. Although all lots have been carefully appraised by experts engaged by our company, in view of the particularity and complexity of the lots, our company hereby solemnly declares that it makes no warranty or guarantee whatsoever regarding the introduction and description of the auction subject matters. Bidders shall inspect and appraise all lots on their own before the auction (and may engage experts to assist in the inspection and appraisal), and bear legal liability for their bidding acts. Once a bidder places a bid, it shall indicate that the bidder accepts the entire current status of the auction subject matter (including defects).
15. For bidders who fail to make a successful bid, they may collect the full amount of the auction deposit (no interest shall be accrued on the deposit) with relevant supporting documents within 3-5 working days after the conclusion of the auction.
16. After successfully acquiring the auction subject matter, the buyer must dispose of it in accordance with the relevant national laws, regulations and provisions. Our company shall not assume any liability for any disputes arising from the buyer's improper disposal of the subject matter.
17. The copyright of all relevant audio-visual materials and catalogues of this auction shall belong to Shanghai Baojiang Auction Co., Ltd. Without the written permission of our company, no unit or individual may reproduce or disseminate the aforesaid materials in any form.
