一、项目概况 本项目拟通过购买法律服务的形式，聘请合适的律师事务所为处理上海浦润物业管理有限公司诉我中心及上海浦东社发资产管理有限公司物业服务合同纠纷提供非诉及诉讼法律服务。 二、服务内容 1.负责草拟、修改、审查有关处理上海浦润物业管理有限公司在承担浦东新区东方路428号宏声大楼的物业管理工作期间的所有法律文件（包括协议、会议纪要、律师函等）。 2.负责调查、搜集，梳理上海浦润物业管理有限公司在承担浦东新区东方路428号宏声大楼的物业管理工作期间的基本情况并出具尽职调查报告。 3.负责代理采购人被上海浦润物业管理有限公司提出的诉讼，包括一审、二审、强制执行等。 4.负责向采购人就有所涉场所物业服务合同所产生的物业费用问题的处理提供解决方案。 5.负责参与接待所涉场所相关的信访、投诉及矛盾化解，协调处置。 三、服务期限 合同签订后至本项目事项处理完毕止。 四、预算价格 人民币3万元（最高限价），如不涉及诉讼则不向委托方收取一切费用。 五、响应条件 1.律师事务所在行业内有较好声誉，所投入本项目的项目执业律师均具有良好的执业道德 2、所投入本项目的执业律师具备房地产专业领域的专业背景和十年以上房地产法律服务执业经验。 3.所投入本项目的律师与政府建设管理部门有良好沟通协调能力。 六、企业资质等级要求 须有律师事务所执业许可证，且至少有1名执业律师。 七、选派方式 根据供应商提交的资质、报价、服务、业绩等材料择优选取1家律师事务所。

（一）在中介集市报名前3个月内存在1次记入一般不良诚信档案行为的； （二）在中介集市报名前1年内存在2次记入一般不良诚信档案行为的； （三）在中介集市报名前2年内存在1次记入严重不良诚信档案行为的； （四）在中介集市报名后中介服务合同签订前，存在记入一般或者严重不良诚信档案行为的 I. One recorded minor bad credit behavior within 3 months before registration in the intermediary market. II. Two recorded minor bad credit behaviors within 1 year before registration in the intermediary market. III. One recorded serious bad credit behavior within 2 years before registration in the intermediary market. IV. Any recorded general or serious bad credit behavior between the registration in the intermediary market and before the signing of the intermediary service contract.
回避情形 Avoidance Situations
（一）参与同一项目采购的不同中介服务机构法定代表人或实际控制人为同一人的； （二）中介服务机构的法定代表人或实际控制人和委托人单位法定代表人或者项目负责人有配偶、直系血亲（含拟制血亲）、三代以内旁系血亲或者近姻亲关系的； （三）其他应当回避的情形； I. The legal representatives or actual controllers of different intermediary service agencies participating in the same project procurement are the same person. II. The legal representative or actual controller of the intermediary service agency has a marital, direct blood (including presumed blood), collateral blood within three generations, or close in-law relationship with the legal representative or project leader of the entrusting unit. III. Other situations that should be avoided.
